Overview

In recent years, laws protecting fetuses under the 14th Amendment have proliferated and now 38 states treat fertilized eggs, embryos and fetuses as potential victims of crime. These laws have myriad unintended consequences, put a wedge between patient and doctor, discourage pregnant women from seeking care and act not in the best interest of healthy pregnancies, but as a punishment to the mother. Personhood follows Tammy Loertscher’s unusual and disturbing case as she mounts a legal challenge to her 18-day incarceration under Wisconsin’s unborn child protection act.
